Chapter 7 and Unsecured Debts

David Siegel: Unsecured debt is debt that there is nothing they can take back, and that would be medical bills, personal loans, credit cards, utility bills, auto repossession, deficiencies.

Jesse Barrientes: Let me ask since we're just going to briefly mention that subject. Child support is really not secured. Does that mean that's something that—

David Siegel: Child support is something that can not be eliminated in a bankruptcy.

Jesse Barrientes: Okay.

David Siegel: Absolutely the court is looking out for the children. The Federal Government is looking out for the children. In fact, in a Chapter 13, they're paid at a higher priority than a lot of other debts, so child support is not only not as treasurable, but quickly paid back under different chapters of the bankruptcy. It's funny you mentioned that.
